4.3.2 Guidelines
For SABMiller’s most significant marks i.e. International and Core brands, the approach should be for systematic, wide and comprehensive protection. The following aspects need to be carefully evaluated in each case:
• Registration of word mark and logo in the countries of manufacture and sale.
• Registration in territories considered economically significant even though the brand may not be used there at the present time.
• Registration in territories known for infringement activities, and where systematic infringement could damage the brand reputation.
• For brand families, filing of the essential elements of the family as well as actual or logical extensions.
• Filing of mark translations or transliterations in territories where they could be used.
• Filing in Classes where there could be complementary use or infringement
Marks with Regional significance should be comprehensively protected within the relevant region, with consideration being given to the factors listed above.
A mark that has local significance only should be fully protected in its local territory.
The IBC will play the role of arbitrator in cases of doubt or where there is a difference of opinion between the trademark owner and a brand custodian as to the level of protection/coverage in any particular case.
