Any of the Parties is not answerable to other Party for non-fulfillment or default in performance of obligations under the present Contract, provided that this failure to perform is caused by acts of God. Выражение acts of God подсмотрела у буржуев в похожем контракте. Жаль, что весь копирнуть не дали. Заранее спасибо за помощь. |

Мб: Neither Party shall be held liable for non-performance or undue performance of its respective obligations hereunder... а еще говорят acts of the elements:) |

Как вариант: Neither party shall, by reason of force majeure, be liable to the other party for failure to perform, or to perform properly, it respective obligations hereunder. |
