| во втором случае не надо писать снова Товар с большой буквы, лучше с маленькой "продукция" (Product vs. goods); "является обязательным" тоже не обязательно, просто "Покупатель вызывает...", damage statement - это пока еще не рекламация, а протокол о выявленных несоответствиях. |
| Никакие рекламации, заявленные по какой-либо части Товара, не могут служить основанием для отказа Покупателя от приемки и/или оплаты другой части Товара, поставленного по настоящему Контракту. - None of the reclamations declared upon any part of the Product shall not be the basis for refusal by the Buyer to accept and/or to pay for another part of the Product, delivered according to conditions of this Contract. |

| Should the quality of the Product(s) prove to be not in accordance with the quality requirements specified in the accompanying documents or should any shortage of goods be discovered, the Buyer shall be required to summon a representative of the Seller to draw up an appropriate damage statement. |

Where nonconformity of the actual GOODS quality to the one set forth in covering documents or its shortage is identified the CUSTOMER shall call the SUPPLIER’S representative for acceptance of the GOODS and signing a non-compliance report. имхо |

| No complaint in respect of any portion of the Product shall serve as the basis for Buyer's refusal to accept and/or pay for any of the other portions being delivered hereunder |
