a) Notwithstanding anything else contained herein,
the Ocean Carrier shall be liable for any and all

any and all liability of wreck removal and the
expense of moving, lighting or buoying the
Vessel, any and all liability in respect of death or
injury of any of the Ocean Carrier’s Servants, all
of which shall be for the sole account of the
Ocean Carrier without recourse against the Yacht
Owner and all of its respective agents, subagents,
managing agents, servants, employees,
contractors or sub-contractors. The Ocean
Carrier shall indemnify, defend and hold the
Yacht Owner harmless from and against any and
all claims, losses, costs and attorneys’ fees
related to loss, damage or liability as referred to
in this sub-clause. Throughout the duration of
this Contract the Ocean Carrier shall procure and
maintain adequate insurance covering all risks
the Ocean Carrier has assumed under this
Contract without recourse against the Yacht
Owner and all of its respective agents, subagents,
servants, employees, contractors or subcontractors.
b) Notwithstanding anything else contained herein
the Yacht Owner shall be liable for any and all
loss or damage or delay of whatsoever nature
and howsoever caused to or sustained by the
Yacht (including loss or damage to the Yacht’s
interior), and including other property on board
the Vessel which is owned, hired and/or leased
by the Yacht Owner, its employees, servants,
agents, sub-agents, contractors or subcontractors,
any and all liability in respect of
wreck removal and the expense of moving,
lighting or buoying the Yacht, any and all
liability in respect of death or injury of any of the
Yacht Owner’s employees, servants, agents, subagents,
contractors or sub-contractors’ personnel,
all of which shall be for the sole account of the
Yacht Owner without recourse against the Ocean
Carrier, the Vessel and/or any and all of their
respective Servants. The Yacht Owner shall
indemnify, defend and hold the Ocean Carrier,
the Vessel and any of their Servants harmless
from and against any and all claims, losses, costs
and attorneys’ fees related to the loss, damage or
liability as referred to in this sub-clause.
Throughout the duration of this Contract the
Yacht Owner shall procure, pay for and maintain
adequate insurance covering all risks the Yacht
Owner has assumed under this Contract,
including but not limited to contributions in
General Average, for its own benefit NAMING
the Ocean Carrier, the Vessel and any and all of
their respective Servants as ADDITIONAL
ASSUREDS and WAIVING ALL RIGHTS
OF SUBROGATION AGAINST THEM.
