Господа, подскажите что означает (к чему относится) "excluding its conflict".

Один знакомый юрист (whose opinion you can rely on :) прокомментировал Ваш вопрос as follows:

это плохо отредактированный текст арбитражной оговорки. Должно быть "...in accordance with the rules of Arbitration of the International Chamber of Commerce in effect at time of arbitration".

"excluding its conflict if any" - эти слова остались по небрежности drafters из precedent model, т.е. "рыбы"?на основе которой писался договор. Это очень хорошо видно из того, что в тексте - "Rules" (plural), и в то же время "its" (сonflict) (singular). Далее, в регламенте ICC НЕ МОЖЕТ БЫТЬ коллизии норм права по определению. Этот пассаж в оригинальной редакции относился не к арбитражу, а к выбору права договора, например:

"Governing Law. This Agreement shall be governed by, and construed in accordance with, the substantive laws of Switzerland, excluding its conflict of law principles that would lead to the application of the laws of any other jurisdiction." И следом за этим - собственно арбитражная оговорка: "All disputes, claims, controversies and differences arising out of or in connection with this Agreement, or the termination, breach or invalidity thereof, shall be referred to and finally settled by arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce."

Вот это "excluding its conflict if any" cмысла в арбитражной [оговорке?]вообще не имеет.
