Subject: acting in the order in which the Secretary-General had received the notice of their acceptance of their appointment to the Tribunal. law Добрый день,Помогите, пожалуйста:) Глаз замылился, не вижу смысла предложения, вижу набор слов. Есть такой абзац в арбитражном регламенте Вашингтонского центра по урегулированию инвестиционных споров: If at any time the President of the Tribunal should be unable to act, his functions shall be performed by one of the other members of the Tribunal, acting in the order in which the Secretary-General had received the notice of their acceptance of their appointment to the Tribunal. В случае неспособности председателя арбитражного суда выполнять свои функции его обязанности исполняет один из остальных членов суда в порядке... А дальше кризис жанра. Действуя в порядке, в котором генеральным секретарем получено уведомление о принятии назначения в состав суда :)))))))) Вообще регламент изложен очень внятным языком, идет легко. Но тут зависла. |

это про очерёдность замещения вакансии остальными членами: кто первый встал, того и тапки по смыслу acting относится к the other members, а не к one of the other members |

очерёдность +1 It's not a very well-written sentence, but 'order' here indicates 'chronological order'. It's saying that the length of service of the other members of the Tribunal, dictates which of them will be first/second/third/etc to be selected to perform the President's functions. So whoever has been a member of the Tribunal for the longest period of time (eg 30 years) will be the first to be selected, and whoever has been a member of the Tribunal for the shortest period of time (eg, 1 day) will be the last to be selected. |

| Я конкретно этот регламент не читал, но это ведь третейский суд, какие 30 лет службы?!?!?! Эти ребята спор разрешают и распускаются. Да и length of service тут ни при чем, потому что трибунал этот не приступает к делу, пока не будет полностью сформирован. Тут просто сказано: от кого первого получили уведомление, что он согласен поработать, тот и замещает председателя. Какой сакральный смысл в таком порядке, хз, по-моему, просто от балды так написали, но смысл такой в тексте |

| Эссбукетов: I'm not an ICSID expert either, but I did check their Convention beforehand, However, I read the wrong part of it. The Tribunals are indeed ad hoc ones rather than permanent/semi-permanent ones, with a completely new Tribunal being created for each case (dispute) and the members of it chosen by agreement between the parties to the dispute. So you're right. |
