Subject: against prevailing cost gen.
Прошу о помощи.
Пункт дистрибьюторского соглашения:

"Dealer" brings in customers for "the products" to the best of his knowledge and abilities and in co-operation with the marketing policy of "XXX". He will offer these products and sell them in accordance with the instructions from "XXX" in the state and packing and under the brands, names, conditions and guarantees as these are sold and supplied to him by "XXX". In doing so "dealer" will exclusively use documentation which he has been provided or approved by "XXX" against prevailing cost.

Выбивает последнее предложение, а точнее последняя его часть "against prevailing cost", настолько, что просто ну никаких догадок и предположений мой мозг не выдает. Если есть какие-то идеи, напишите, pls.

Okneding, это никакая не цена, а именно себестоимость. Обычная практика для дистрибьюторских отношений: за пользование маркетинговой документацией продавца с дистрибьютора денег не берут (на этом не навариваются, там профит по-другому генерируют), просто продавец хочет покрыть свои расходы на подготовку этих документов. А поскольку расходы постоянно меняются, написано prevailing, т.е. в размере тех расходов, которые складываются на момент передачи док-ов.

This hasn't been written by someone with a native-level knowledge of English. The English in it is 7-8/10, but most of the words/phrases you can't understand come under the bits that aren't written in proper English.

'to use (sth) against prevailing cost' isn't correct English. It may mean 'to offset (sth) against prevailing cost' [eg, for accounting purposes]. I'm not even sure what 'prevailing cost' means here, although others may know.

Also it should read: '"dealer" will exclusively use documentation which has been provided to him by "XXX", or has been approved by "XXX"'.

Here are several synonyms for a word 'prevailing': prevalent, current, predominant, widespread.
I'd rather agree with johnstephenson about the improper English used by the author of the above DA (Distribution Agreement) clause.
Yet, in Russian I'd translate "against p.c." as "вопреки превалирующей цене / стоимости" (сложившейся на рынке подобных услуг) с целью сбить эту цену.
Just read again: "He [dealer] will offer these products and sell them in accordance with the instructions from "XXX"... In doing so "dealer" will exclusively use documentation... against prevailing cost." To me, it all sounds a bit too ominous/
