Mario Cuomo, won a partial victory in federal court in Fort Lauderdale on Thursday as a judge dismissed a portion of a lawsuit against him. Cuomo and 10 others are being sued by Lynn Fenster Smith of Fort Lauderdale. Smith, chairman of Oceanmark Federal Savings and Loan, alleges that Cuomo and the others conspired to take over the North Miami Beach thrift illegally. U.S. District Judge Jose Gonzales on Thursday said private individuals or companies do not have the right to sue under the federal law governing changes in control of federally insured savings and loan associations, according to Jan Atlas, a lawyer representing Cuomo.
