If the Contract Party does not accept such programme and the Contract Party and the Engineering Organization are not able to agree on the programme or the cost and payment terms of the Additional Services, the Contract Party may instruct the Engineering Organization to carry out the Additional Services in accordance with a programme determined by it and on the cost and payment terms set out in this Contract in respect of the Services, pending agreement between the Parties or determination under Clause 23.
