Контекст: Contractor agrees to defend, indemnify and hold harmless any Indemnified Party from and against all third-party claims, including any damages, losses and expenses, including attorneys’ fees, arising out of or resulting from those third-party claims, by or on behalf of Workers or other Contractor personnel, or any governmental or quasi-governmental entity, alleging claims or levying fines or penalties predicated on concepts of common law employment or joint employment, including, but not limited to, claims (i) that such Workers or other Contractor personnel should be treated as an employee of an Indemnified Party, (ii) that such Workers or other Contractor personnel are entitled to the employment benefits accorded employees of an Indemnified Party, (iii) that such Workers or other Contractor personnel are being supervised by or otherwise controlled by an Indemnified Party, or (iv) related to or arising out of the employment or engagement, or termination of employment or engagement, of any Worker or other Contractor personnel.
