Dear forum,

What does this mean in the context below?

Судом установлено, что ответчик, являясь отцом ребенка не имея препятствия со стороны истицы, уклоняется от уплаты алиментов, что подтверждается сообщением судебного пристава.

Also: does "не имея препятствия со стороны истицы" mean that he was not impeded by the plaintiff (истица) in paying alimony?

Thank you, Karabas. Could you describe what a bailiff does? I'm translating to Dutch and I find a lot of meanings English-Dutch for "bailiff"..

Jilt, there are a lot of other translations of "судебный пристав". Look here http://alk.pp.ru:8080/c/m.exe?CL=1&l1=1&s=��������+�������+ and may be you'll find some word that will satisfy you more.

IMHO: The court has found that the defendant (who is the father of the child) evaded alimony payments though he was not impeded [to pay alimony] by the plaintiff.
судебный пристав is a kind of "legal debt collector", an officer authorized and empowered by court to enforce such court's judgment unless it is executed by free will.
