A very important fact about the whole neighbourhood is that the County of Stilton became an area of compulsory land registration on 1 December 1990. We know that this will not mean a lot to you at the moment, but we will explain in Chapter 2 what it involves.
Throughout the book we will use some of the properties in Trant Way to illustrate the application of land law rules in practical situations. Chapter 1 has to be rather theoretical, because we want to give an outline introduction to the various rights which people can have over land. We are, as it were, getting the chess pieces up on the board, and telling you what they are called and how they move. Once you can recognise these rights, we will work through the process of acquiring title to land in Part II and then spend the rest of the book looking at some of the rights over land in more detail. We will leave the discussion of the question 'What is land?' to the end of the book. It is one of the more technical areas of the subject, and we think you will find it easier to follow at a later stage.
We have not included any general introduction to equity because students often study land law and equity (or trusts) at the same time, and in such a case your studies in equity will provide the background knowledge which is needed for land law. If however, land law precedes equity in your course, or if you are not required to study equity in detail or you are not a law student, we do advise you to read some outline introduction to its history and nature. Some suggested references are given at the end of Chapter 1.
1925 property legislation
Finally, this is a convenient place in which to mention the property legislation which was passed in 1925 and which came into force on 1 January 1926. This legislation consolidated earlier amendments to land law, put into statutory form some common law rules and introduced further reforms. This turning-point in land law was contained in the following statutes:
Settled Land Act 1925
Trustee Act 1925
Law of Property Act 1925
Land Registration Act 1925
Administration of Estates Act 1925
Land Charges Act 1925
These statutes have been amended by later enactments and in some cases are largely superseded by later statutes. For convenience we have used the following abbreviations throughout the book, giving the year in each case, in order to avoid confusion where there are two or more statutes with similar names:
SLA—Settled Land Act LPA—Law of Property Act LRA—Land Registration Act LCA—Land Charges Act
More recently, the Trusts of Land and Appointment of Trustees Act 1996 has introduced major changes to the important area of trusts of land. You will find that Act referred to here as TOLATA 1996.
