Subject: backcharges что за зверь? gen. Seller shall not be responsible for backcharges or field modifications performed by Buyer unless Seller authorizes such charges in writing prior to the incurrence thereof.как в этом контектсе обозвать эти backcharges? |

Back Charge- Billings for work performed or costs incurred by one party that, in accordance with the agreement, should have been performed or incurred by the party to whom billed. Owners bill back charges to general contractors, and general contractors bill back charges to subcontractors. Examples of back charges include charges for cleanup work or to repair something damaged by another subcontractor, such as a tub chip or broken window. Я так понимаю, что байер может понести какие-то расходы, которые теоретически мог бы взыскать с Продавца, но не тут-то было - если последний такие расходы не согласовал, то он за их возмещение не несет ответственности... |

Вот как определены эти backcharges в наших контрактах: A backcharge is a cost sustained by Company and chargeable to Contractor for Company's performance of Work that is the responsibility of Contractor. В русском варианте это называется "обратные начисления". В корректности самого термина сомневаюсь, но поскольку в теле контракта дается его объяснение, то вопросов обычно не возникает. |
