Black's Law Dictionary (8th ed. 2004)
[Latin] According to what is equitable and good.
• A decision-maker (esp. in international law) who is authorized to decide ex aequo et bono is not bound by legal rules and may instead follow equitable principles. For example, article 38(2) of the Statute of the International Court of Justice provides that the Court may “decide a case ex aequo et bono if the parties agree thereto.”
