This is true notwithstanding the fact that the arbitrators did not explain their decision on this point further than to note that the Tribunal was exercising its discretion in light of the novelty of the issues raised....несмотря на тот факт, что арбитры, разъясняя свое решение по данному пункту, ограничились лишь тем, что отметили, что Арбитражный суд осуществил свое право усмотрения ввиду принципиально нового характера затронутых вопросов...? (не нравится "новизны")
