Скажите, пожалуйста, как именуется "Принципал" в банковской гарантии (в переводе на англ.)? У меня в англоязычной гарантии его Applicant кличут. Насколько это корректно?

И еще вопрос: как лучше (и как принято) переводить синонимичные английские словосочетания типа null and void, objection and defence etc., контекст примерно такой: This being stated we, ………….., with its seat at (...) (hereinafter called 'the Bank'), waiving all rights of objection and defence arising from the principal debt, without any evasion, contestation or objection and without any counterclaim, hereby irrevocably and unconditionally undertake to pay you on your first demand, any amount up to ...

Но, по-хорошему (я понимаю что вы просто переводчик) нужно спрашивать/смотреть по контексту, сделке и подчиненности гарантии.
Ибо там в правилах всяко может быть поименовано.
Вот в последних например есть такое
APPLICANT means the party indicated in the guarantee as
having its obligation under the underlying relationship supported
by the guarantee. The applicant may or may not be the
instructing party
и
INSTRUCTING PARTY means the party, other than the counterguarantor, who gives instructions to issue a guarantee or counterguarantee and is responsible for indemnifying the guarantor or,
in the case of a counter-guarantee, the counter-guarantor. The instructing party may or may not be the applicant;

И ваш принципал в зависимости от контекста может быть как applicant, так и instructing party, или и то и другое в одном лице (двуликий Анус, как говаривал Толян :) )
