A “No-Application Understanding” (as I use the term) of a prohibitory commitment (запрет) is any understanding of the form, “The commitment does not apply to (does not prohibit) x.” As in: “The First Amendment does not prohibit the sale of flour in ten-pound bags.” By contrast, an Application Understanding is an understanding of the form, “The commitment does apply to (does prohibit) x.” As in: “The First Amendment prohibits prior restraints.” [The first three chapters of this book show that, strangely enough, constitutional law has for two centuries drawn a distinction between historical understandings along these lines. Constitutional doctrine, from the outset to the present day, has systematically stuck to historical Application Understandings, even while very frequently overturning historical No-Application Understandings. |
