A critical point for the allocation of capacity rights and tariff determination may be for the pipeline and terminal to gain an exemption from Kazakh natural monopoly and petroleum legislation or find an acceptable way to exist within it. This may be achieved by demonstrating that the pipeline is being built for the “own needs” of the investors and will operate at full capacity. This may then allow the partners to determine priority capacity rights and tariffs for themselves. However, if not all parties were investors, then it may not achieve a key objective of handling most of NCPSA’s volumes.
