Company X is now looking for an additional penalty payment of $250k if we have not provided a term sheet to either restructure or refinance the debentures by Sept, 2007. After a long day of negotiations, we have been unable to get them to move off this point. With that as a sticking point, it makes more sense to pay the $250k now as we are not getting enough benefit to term the money out 50/50 over the next 30 days.
