Neither party may require a Margin Transfer to it under the Agreement unless the Net Exposure of a party, in respect of the other party is in excess of the Minimum Exposure (as defined hereafter) in respect of all outstanding Transactions, provided that the Minimum Exposure shall be deemed to be zero if at any time (a) there are no Transactions outstanding or (b) there has occurred and is continuing an event which, with the delivery of a Default Notice by the non-Defaulting Party, would constitute an Event of Default. In such case, such party may require the other party to pay Margin to reduce the Net Exposure of such party to zero.

Ни одна из сторон не может запросить Передачу Маржи в соответствии Соглашением, до тех пор пока Чистая рисковая сумма стороны в отношении другой стороны не превысит Минимальную рисковую сумму (как определено далее) в отношении всех all outstanding Transactions, при условии что Минимальная рисковая сумма считается равной нулю, если at any time (a) there are no Transactions outstanding или (b) наступило и продолжается событие, которое, в случае подачи Уведомления о неисполнении Исправной Стороной, составило бы Событие Неисполнения.
