Принято выделять фактическую (ст. 416 ГК) и юридическую невозможность исполнения обязательства (ст. 417 ГК). Фактическая невозможность исполнения означает невозможность исполнения обязательства в натуре, например, обязательство продавца по передаче в собственность покупателю индивидуально-определенной вещи (картины известного художника, ювелирного украшения, созданного по индивидуальному заказу) прекращается в случае ее гибели. Для прекращения обязательства по этому основанию необходимо наличие двух условий в совокупности: • невозможность исполнения вызвана наступившим после возникновения обязательства обстоятельством; • ни одна из сторон не отвечает за наступление указанных обстоятельств.

As mentioned, contracts are generally discharged when all parties have fulfilled their legal obligations in their contractual agreements, however, contracts can also end due to an impossibility of performance.
There are many reasons why it may become impossible for a party to perform their contractual obligations, some reasons include an unforeseen change in the law, an occurrence of a natural disaster, or anything else that renders the performance of the contract illegal or fundamentally different from what was initially intended.
