Memorandum of Wishes (учредителя траста;? These are notes from the Settlor to the Trustees. They are not binding on the Trustees but are considered carefully by them when making decisions. Where the memorandum is issued by the Settlor at or prior to settling the Trust, those wishes can form part of the powers of the Trustees authorising them to act in a way that would otherwise render them liable to claims that they had failed to act prudently. e.g. where the asset settled on the Trust is not one which Trustees should normally consider for investment of Trust funds.
