Неочевидный вопрос. Пошире контекст не помешал бы. Могу предположительно, в порядке вождения вилами по воде, предложить следующие варианты: The business purpose / economic purpose/ intent (хуже: end / objective) of certain transactions (carried out/undertaken/performed etc… on behalf of a client) may not always be straightforward / readily ascertainable / evident/obvious/clear/transparent The objective a transaction is purported to pursue / meant / designed to achieve may not always be clear/clearly understandable/transparent The ostensible / putative / purported (business) purpose of a (business) transaction may nor always be what the transaction is actually (all) about / may not be what it seems / what it appears to be prima facie Prima facie purpose may not always be (indicative of) the actual/ effective / real purpose of a transaction Etc С business sense надо осторожнее. Термин обманчив. В некоторых контекстах читателем Вашего перевода может быть ошибочно понят как «деловое чутье». |

Я делала поиск именно по "apparent economic", потому что что-такое вертелось в голове. По-моему, это было в какой-то сурьезной директиве и стало потом тиражироваться. Похоже, что наши пользуются переводом. |
