Under no circumstances, shall the Supplier’s compliance with the Letter’s annual objectives be interpreted as limiting or excluding its responsibility or liability under the contract, or any applicable law or regulation for any failure even if the annual objectives under the Letter are reached 

Regarding specific reference to security or regulatory obligations, the objectives communicated in this letter do not in any way constitute a tolerance in relation to such obligations
