Контекст: The parties entered into amendment no. 1 (‘Amendment 1’) to amend the Agreement due to amendment 1 (dated 2015) to Protocol no.3 (dated 2013). A copy of Amendment 1 is attached as Appendix 1 to this Addendum. Стороны заключили Дополнительное соглашение № 1 (Доп. соглашение 1) для внесения изменений в Договор???? у вас тут в кучу кони люди. надо бы посмотреть, amendment no. 1 (‘Amendment 1’) и amendment 1 (обратите внимание на отсутствие значка №) - это два разных амедмента? еще и Appendix 1 (ну, тут легко разводится, если чо) к какому-то Addendum-у... ой, мама, короче:) |

The parties hereto entered in to a Agreement (‘Agreement’) for the conduct of the study entitled <ХХХХ> with Protocol Number <ХХХХ> (‘Protocol’). B. The parties entered into amendment no. 1 (‘Amendment 1’) to amend the Agreement due to amendment 1 (dated 2015) to Protocol no.3 (dated 2013). A copy of Amendment 1 is attached as Appendix 1 to this Addendum. C. The effective date of Amendment 1 cannot be ascertained with certainty. NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: 1. The effective date of Amendment 1 is 2015. 2. Save as otherwise provided in this Addendum, all the terms and conditions of the Agreement and Amendment 1 shall remain in full force and effect. *Насколько я понимаю Memorandum это Addendum* чует мое сердце, что это опять гугл-транслейта шалости - он такое любит - одно слово тремя разными переводить в трех разных фразах... мое мнение - всё хайлайтить и заказчику - пусть сам разбирается. потому что хорошо, если меморандум будет нигерийский - они их сотнями штампуют, но чтоб по ним кто когда работал - нет, не слышал... а если вдруг сдуру рабочим окажется, может тогда ситуация возникнуть, как у той переводчицы с соседней ветки - тьфу, не дай бог:)) |

'The parties entered into amendment no. 1 (‘Amendment 1’) to amend the Agreement due to amendment 1' doesn't make sense in English. Badly written or possibly badly translated into English. |

johnstephenson, Maybe it was meant to say something like: Parties had to make Amendment 1 to Agreement because an Amendment 1(same name, but different document) to Protocol 3 has previously been made? |

step11: It could be -- but in that case the second sentence should really read 'A copy of Amendment 1 TO PROTOCOL No 3 is attached as Appendix 1 to this Addendum' to avoid any ambiguity. However, even with this change, the first sentence is still tautological/badly written, as others have said: why say 'the parties entered into amendment no. 1 .... to amend the Agreement'? That's like saying 'I'm going into town to go into town'. It would have read better if they'd written something like 'the parties entered into amendment no. 1 .... to (MODIFY/ALTER) the Agreement' -- to avoid repeatedly using 'amend'. It's not very well written. |

а чё тут непонятного, я не понимаю? Плейн Инглиш. Memorandum of Agreement = Agreement amendment no. 1 (‘Amendment 1’) - поправка номер один (далее "поправка1") Addendum - приложение/дополнение. стороны согласились на поправку1 к соглашению, подписанному в 2015 году на основании протокола от 2013 года. Копия поправки1 прилагается в качестве приложения 1 к данному дополнению. |

*** чё тут непонятного? *** Amor 71: Your Russian reads clearly enough -- but the English original doesn't. If you've already mentioned 'amend'/'amendment' several times in the same sentence, it's not a good idea to use it again in the same sentence when you don't need to. Compare: The two mean the same, but the second is easier to read. People need to be able to understand things the 1st or 2nd time they read them, not the 99th! |
