Есть как минимум 2 клише на "за неисполнение или ненадлежащее исполнение своих обязанностей...(обязательств)..." Ваше any failure to perform не покрывает "ненадлежащее исполнение"... only if the loss, shortage or damage was due to... = only if such loss, shortage or damage was caused by... любят они "such"... Кстати, почувствуйте разницу между appropriate (скорее "надлежащий ") и respective. If the CONTRACTOR proves that the violation of its obligations due to improper execution of the corresponding contract = If the CONTRACTOR proves that the violation of its obligations was caused by improper fulfillment of the respective...
