Abbott today found that bingo tickets, pull-tab bingo tickets, gift certificates and other such prizes awarded by eight-liners do not meet the requirement for the “fuzzy animal” exclusion from Texas’ constitutional prohibition against gambling. In other words, if any bingo hall operators are using eight liners to award free bingo tickets etc to players, they need to stop, Abbott’s opinion would indicate.

The opinion was requested in April 2010 by Texas Lottery Commission Chair Mary Ann Williamson and Rep. Senfronia Thompson (D-Houston). In Texas, eight-liner gambling devices are not illegal in themselves. It depends on how they are operated. Under Texas law, eight-liners can only award “noncash merchandise prizes, toys or novelties” like fuzzy animals, to those who play them.
