Subject: ask/take price gen. Не могу найти перевод или определение термина "ask/take price". Контекст следующий: Sales Agency Agreement, речь идет об услугах агента при заключении лицензионных соглашений с дистрибьюторами о предоставлении прав на фильм. Абзац гласит:"Notwithstanding anything to the contrary contained in this Paragraph 3, if and to the extent that Licensor, its parent, affiliate and/or subsidiary owns or controls any sequel, prequel and/or remake rights in and to the Picture (Subsequent Production Rights) thoughout the Territiry and provided that Sales Agent has procured cumulative sales of the Picture thoughout the Territory in the amount of the cumulative take price (Cumulative Take Price) as set forth in the Ask-Take Schedule (as such capitalized term is defined in Paragraph 9 below) then the Sales Agent shall automatically be engaged as the exclusive sales agent thoughout the Territory with respect to all Subsequent Production Rights on the same economic and other terms as set forth herein. Пункт 9 опять же ничего не проясняет, там написано следующее: "The parties have mutually agreed a set of ask-take prices referred to herein as the Ask-Take Schedule which is attached hereto and incorporated herein as Exhibit A." Других упоминаний в тексте договора нет, приложений тоже нет. Буду благодарна за любые идеи. |

Это специфически киношное... Ask price -- это начальная цена, которую агент будет просить с покупателя. Торг уместен. Take price -- в зависимости от контекста это либо минимальная цена, на которую агент, представляющий правообладателя, имеет право согласиться (устанавливается соглашением между правообладателем и его агентом и не видна потенциальному покупателю), либо фактическая цена, по которой права проданы. |

***Это специфически киношное... Вы это это утверждаете или предполагаете? Недавно нашел пример совершенно из другой сферы Police .... say they took a call from a man who was upset that the price he agreed to pay for prostitution services had increased unexpectedly....the 45-year-old man and a 19-year-old woman he had contacted online agreed on a price, but the man claimed that she upped the cost after taking his money. ' ask/take price :) |

| ИМХО, это индикативы цен продавца и покупателя. Кас. п.9: возможно, что стороны установили верхний и нижний интервалы цен, в пределах которых возможно торговаться (cf. ask/bid price) |
