спасибо, ochernen. очень помогли ) у меня простое оборудование (грузоподъемный мех-зм). думаю, выкручусь вот так: Equipment shall not infringe any patent rights valid in the RF (be of non-infringement quality)... хотя... сомнения остались.. может ли equipment infringe.. и ... ну хорошо, оно не нарушает патентных прав, выданных на территории РФ, а что с другими правами.. вот эта территория РФ сбивает с толку конкретно... ) |
... почему территория Российской Федерации?... ... да все очень просто: Не требуется разрешения патентообладателя и не выплачивается вознаграждение при использовании таких решений в случаях, когда имеет место ввоз на территорию Российской Федерации, применение, предложение о продаже, продажа, иное введение в гражданский оборот или хранение для этих целей продукта, в котором использованы изобретение или полезная модель, либо изделия, в котором использован промышленный образец, если этот продукт или это изделие ранее были введены в гражданский оборот на территории Российской Федерации патентообладателем или иным лицом с разрешения патентообладателя. Речь идет о случаях, когда патентные права признаются исчерпанными. В основе данного права лежит так называемая теория исчерпания прав патентообладателя, разработанная в патентных системах промышленно развитых стран. It should be borne in mind that the principle of exhaustion of rights under the Code is territorial in nature, within the Russian Federation only, and re-sale of such products to other countries should take account of national patents and national legislation in relation to the interpretation of the principle of exhaustion of rights. |
