До вступления судебного решения в законную силу арбитражный суд вправе либо оставить иск без рассмотрения при наличии тождественного спора (часть 1 ст.248 АПК) либо приостановить производство по делу в российском суде в связи со значением для российского процесса результатов иностранного процесса (п.5 ст.144 АПК).
