| Pending -- это не "угроза проведения разбирательства". В зависимости от контекста это может означать либо судебный процесс, по которому еще не вынесено решение, либо (более узкое определение) судебный процесс, в котором иск уже подан, но разбирательство еще не началось. В обоих случаях угроза уже не угроза, а свершившийся факт -- исковое заявление находится в суде. Во втором случае, однако, возможно, что суд, получив ответ ответчика на жалобу истца (а также материалы от третьих сторон, например, amicus briefs) может отказать истцу в рассмотрении иска. |

123, Вы уже все сами себе объяснили. Pending or threatened -- это один контекст (иск может быть подан, а может быть и не подан). Ongoing or pending -- другой (разбирательство либо уже началось, либо еще нет). |
