The basic rule is: one is entitled to/claims/claims compensation for/collects/is awarded moral DAMAGE/DAMAGES, but one suffers moral INJURY (also possible, but less popular = suffer moral loss, although there's a tendency to say "suffer material and moral loss"). |

Toast2 - one is awarded moral damages - I agree, but I couldn't be bothered to write out every example individually. Monday morning, have a heart.... suffers damage - right, but not really when talking about people. Things, property, etc. sure. |

toast 2, as regards persons, I beg to differ. I can't think of an example of, say, "he suffered damage" without anything attached, e.g. he suffered damage to his car, he suffered brain damage, he suffered damage to his reputation but bald "he suffered damage", never come across it and it sounds wrong. |

harry, just because you "never come across it" does not mean it does not exist or is otherwise wrong (: "the claimant suffered loss and damage" is a standard opening sentence from a claim form / statement of claim/case |

| toast2, you're logic is correct - the fact I haven't come across it doesn't mean it doesn't exist (the fact I haven't ecountered fairies at the bottom of the garden doesn't mean they don't exist ...), but, please note, I'm not talking about "suffer damage AND LOSS", but "suffer DAMAGE" (see my last note). I like to think I'm open to learning new things, to wit, I'd appreciate a few examples of "suffer damage" if you have them to hand. Thanks in advance... Best regards Harry |

harry, to be blunt, all it means is that you have not encountered such a phrase. period. and no wonder, since you do not read legal stuff. my advice is, read legal stuff (: by way of example, try accessing the high court database, or better still, just go there one day, they are on the strand, and nearly all hearings are public. ask to be shown a "claim form" (previously, before lord woolfe's reform, known as "statement/particulars of claim"). read carefully, i did not say "damage and loss", i said "(loss and) damage". it's a term of art. good to know before you venture to "help" topicstarters |

toast2: Um, er.... actually I do translate "legal stuff", in fact, quite a bit of it, albeit not exclusively. No doubt, not very well. Thank you for your advice. I shall make a point of taking the wife and 3 children to the Strand where "they" (I assume you mean the Royal Courts of Justice) are located for an educational visit next time we are in London.Thank you, also, for telling me where they are. As a Londoner, I did not know that. I wish also - publicly and with all humility - humbly to beg the pardon of all MT "topic starters", whom I was insolent enough to "venture to help". It was wrong of me, I was naughty, and Nanny would not approve. Still waiting for evidence of "suffer damage", old chap... Again, I have no issue with "loss and damage". My apologies for absent-mindedly putting the words in the wrong order. |
