Контекст:

Neither Party will (i) disclose the existence or contents of this Agreement, nor the basis of any disputes, claims or allegations relating to the Matter, unless, and only to the extent, necessary to report income to any taxing authority, or as may be required by law or pursuant to a legal proceeding; nor (ii) disparage the other or their respective affiliates.

По пункту (i) смысл понятен, а вот (ii) вызвал затруднение.
disparage - это пренебрежительное отношение, а к чему может оноситься "the other"?

есть предположение, что "disparage the other or their respective affiliates" = умалять достоинство (порочить) другую Сторону или ее соотвествующих аффилированных лиц
