Subject: take benefit of Буду чень благодарна за помощь:главным образом мне не очень понятно то, что идет после "take the benefit of" P.S. в настоящем договоре гарантор и собственик - это одно и то же лицо So long as the Owner remains under any actual or contingent obligation under this Agreement, the Guarantor shall not exercise any rights which it may at any time have by reason of the performance of its obligations under this clause to be indemnified by the Owner, to claim any contribution from any other surety of the obligations of the Owner or to take the benefit (in whole or in part and whether by way of subrogation or otherwise) of any of the rights of the Investor under this Agreement or of any other security taken by the Investor pursuant to or in connection with this Agreement Заранее благодарю :) |

| Спасибо, Елена. получается пользоваться себе во благо правами Инвестора или гарантийными обязательствами, взятыми Инвестором по настоящему Согалшению. так? |

| Точно. Security -- обеспечение. Обеспечение, предоставленное Инвестору на основании или в связи с настоящим Договором. |

Елена, а не могли бы Вы мне помочь с еще одним моментом. вот текст: 20.5 The liability of the Guarantor pursuant to this clause shall not be affected by the avoidance of any assurance, security or payment or any release, settlement or discharge which may have been given or made on the faith of any assurance, security or payment, in either case, under any enactment relating to bankruptcy or insolvency. не знаю, как здесь перевести assurance и как лучше переевсти affect? На обязательства Гаранта не влиет избежание ...или может Обязательства Гаранта остаются в силе/ неизменными. Очень надеюсь на Вашу помощь :) |
