Subject: За непредоставление документации в срок... Прошу проверить перевод пункта из договора на разработку и поставку рабочей конструкторской документации:исходник: За непредоставление документации в срок, указанный в Приложении 2, Исполнитель выплачивает Заказчику пени в размере 0.2% от общей стоимости работ за каждый день просрочки, начиная с пятого календарного дня, на который просрочен срок, но не более 20% от цены работ по договору. При задержке поставки документации в срок более чем на 15 календарных дней после истечения срока, указанного в Приложении № 2, Заказчик вправе расторгнуть договор в одностороннем порядке, а Испольнитель обязан в течение 10 банковских дней с момента расторжения настоящего Договора вернуть Заказчику денежные средства, полученные от Заказчика по настоящему Договору, в полном объеме. Перевод: Should the Contractor fail to deliver the documentation within the period stipulated in Appendix # 2 the Contractor is obliged to pay a fine in the amount of 0,2 % of the total cost of work for each day of the delay starting from the fifth calendar day of the delay, but not more than 20% from the total cost of work under the Agreement. Should the delay exceed 15 calendar days from the date stipulated in Appendix #2, the Customer reserves the right to cancel the Agreement unilaterally and the Contractor is obliged to return to the Customer all the payments received from the Customer within 10 banking days from the date of the cancellation of the present Agreement. ИМХО 20% OF the total cost ...received from the Customer UNDER THIS AGREEMENT (по настоящему договору - вы упустили) ну и запятые... |

consider: Should the Contractor fail to deliver/make available/submit/present the documentation within the timescale/line/period/before the deadline indicated/stated/provided/stipulated in Appendix # 2 the Contractor shall [be obliged/required] to pay/be charged penalties [to the amount] of 0.2 % of the total cost of work for each day of delay starting from the fifth calendar day of the delay to a maximum of 20% of the total cost of work agreed on herein. |

Should the Contractor fail to deliver the documentation within such date as specified in Appendix # 2, the Contractor shall pay a fine of 0.2 % of the total cost of work for each day of the delay starting from the fifth calendar day of the delay, but not more than 20% of the total cost of work hereunder . Should the delay exceed 15 calendar days from the date specified in Appendix #2, the Customer shall reserve the right to cancel the Agreement unilaterally and the Contractor shall return to the Customer all the payments received from the Customer within 10 banking days from the date of the cancellation hereof.
