During the Warranty Period and in its sole discretion, Seller will repair, replace, or refund the purchase price of any Product that is determined to be defective or in nonconformance with Seller’s specifications, or such other specifications as may be mutually agreed upon in writing. The forgoing remedy is Buyer’s exclusive remedy for breach of warranty. Buyer shall not return defective or nonconforming Products until authorized in advance and in writing by Seller.
