Subject: Instruction law Добрый день,Уже почти неделю мучаюсь с комментариями к нашему УПК, комментарии написаны, видимо, американцем. Постоянно, буквально через предложение, встречаются сочетания со словом instruction, Несколько примеров: When does the person become the “accused?” One reading of the first paragraph of Статья 48 is that “court proceedings” mean the trial phase following the instruction investigation. The instruction context of the binding and restriction application is further declared by the fact that it is applied by the inquirer, investigator, or prosecutor as instruction officials during the investigation period. Есть еще пассажи про instruction judge и т.д. Насколько я понимаю под instruction подразумевается "предварительное следствие", но "судья, занимающийся вопросами предварительного следствия" как-то не звучит. Есть ли какой-то устоявшийся перевод этого дела? Заранее спасибо. |

Да, Владимир, это то предварительное следствие, то следователь. instruction judge - следователь. Просто у них, по крайней мере во Франции точно, следователи являются судебными служащими. |

| Таня, спасибо. Дело в том, что там постоянно говорится о дознавателях, следователях и прокурорах (inquirers, investigators and prosecutors) и о том, что они подменяют собой вот этого instruction judge, когда выносят постановления, скажем, о возбуждении уголовного дела. Поэтому нужно его как-то по-другому обозвать. "Судебный следователь" тоже, мне кажется, не очень...Вот "судью" бы как-нибудь обыграть... |
