1. The legal rules of evidence are found in statutes, case law and constitutions. The purpose of these rules is to govern admissibility of information in legal proceedings, but they are drafted with a view to protecting the parties as well as ascertaining the truth.
a) Exclusionary rules operate to prevent the admission of evidence whose value as proof is offset by its possible prejudicial effect. An internal auditor should not be restricted by legal or constitutional safegurds imposed in court. He/she may examine and evaluate any information until reliable and useful information has been collected. In this text "eveidence" is used strictly in the legal context and "information" is used for anything that can support auditor's observations.
