If the Customer is overdue on any payment due under a Contract, then the Service Provider may request interest on the overdue amount at an annual rate equal to one percent (1%) above the 1 month Euribor (Euro Interbank Offered Rate) as quoted by Financial Times on the date of the due date of the invoice or the maximum rate permitted by applicable law, whichever is the lesser, which interest shall accrue on a daily basis from the date payment becomes overdue until the Service Provider receives payment of the overdue amount.

определяется ставка для начисления штрафного процента на сумму просроченного платежа (Еврибор +1%), поэтому "пеню в размере 1% выше ставки Euribor" не совсем точно
