Subject: official legalization law Обращаюсь к специалистам с просьбой перепроверить мой перевод следующего абзаца для научной статьи:"Таким образом, официальная легализация дискреционных правомочий может носит как прямой, так и косвенный характер. Последняя, обоснованно замечает Г.А. Прокопович, имеет место тогда, когда государственный орган, должностное лицо оказывается перед выбором, не обусловленным указанной нормой, хотя правовой вопрос относится к его компетенции. У меня получилось вот что: "Thus, the official legalization of discretionary powers can be both direct and indirect. The latter, as G.A. Prokopovich rightly remarked, occurs when a state body or official has a choice not due to a legal norm, although there is an issue related to their competence". Заранее благодарен за любые рекомендации! |

" a legal norm" - а почему артикль неопределенный? "указанная" - the ... although an issue in question is intra vires ? |

Заменил бы: ...can be direct or indirect. ...as G.A. Prokopovich reasonably remarked, takes place when... ... an issue falling within its or his scope of authority. |

* обоснованно замечает - rightly points out * имеет место - occurs * правовой вопрос относится к его компетенции - (a legal issue/the legal aspects of an/the issue) fall(s) within its/his (remit/area of authority/terms of reference) Volinga's 'intra vires' may also be OK -- but I can't be sure, as I'm not a legal expert. |
